Divorce/Legal Separation or Annulment

Medical and Dental Coverage

You must initiate the eTrac transaction within 30 days of the effective date of the divorce, legal separation or annulment to remove your spouse from your medical and dental coverage and stop or change your payroll deduction. Your ex-spouse or spouse from whom you have legally separated will be sent notification about the opportunity to continue coverage under the provisions of COBRA. If COBRA is elected, the ex-spouse or spouse from whom you have legally separated may be covered under a continuation plan for up to 36 months by paying the full premium cost plus a 2% administrative fee. COBRA rights will be forfeited if Benefits is not notified within 60 days of the termination of the coverage. Claims will not be paid for an ineligible ex-spouse or spouse from whom you have legally separated beyond the end of the month in which the divorce, legal separation or annulment is effective and premiums paid for the ineligible spouse's coverage will not be refunded retroactively.

The Office of Benefits Administration will request a copy of the divorce, legal separation or annulment decree before they can approve your eTrac transaction. Dental coverage is not included in the medical plan; you will need to initiate a termination of benefits via eTrac to remove your former dependent from your dental coverage.

 

Flexible Spending Accounts

You may initiate or change the amount of a health care or dependent care FSA via eTrac within 30 days of divorce, legal separation or annulment. A copy of the divorce, legal separation or annulment decree is required.

 

Life Insurance and Accidental Death and Dismemberment Insurance

If you have other dependents covered, the ex-spouse or spouse from whom you have legally separated will no longer be covered under the policy. If the ex-spouse or spouse from whom you have legally separated was the only eligible dependent you had covered, you will need to submit a Benefit Cancellation Form to end their dependent coverage. You may wish to review your beneficiary designation(s) and update if necessary.

 

AFLAC

Contact AFLAC at (800) 992-3522 to discontinue your ex-spouse's or spouse from whom you have legally separated premium from your payroll deductions. Your ex-spouse or spouse from whom you have legally separated may continue coverage on a direct bill basis.

 

Long Term Care

Contact the Long Term Care Carrier directly to discontinue your spouse's premium from your payroll deduction. Your ex-spouse or spouse from whom you have legally separated may continue coverage on a direct bill basis.

 

Retirement Plans

If you need information about preparing a qualified domestic relations order to divide assets held in your retirement plan, please contact the Office of Benefits Administration. You may wish to review your beneficiary designation(s) and update if necessary.

 

Tuition Assistance

A spouse who is legally separated or a former spouse divorced from a sponsoring employee is not eligible for tuition assistance.
