ENVIRONMENTAL LAWS OF APEX COUNTY

SECTION ONE: Air Pollution Emission Standards for Discharges Into the Air of APEX County Rule 1. Nuisance A person shall not discharge from any source whatsoever such quantities of air contaminants or other material which cause injury, detriment, nuisance or annoyance to any considerable number of persons or to the public or which endanger the comfort, repose, health or safety of any such persons or the public or which cause or have a natural tendency to cause injury or damage to business or property. Rule 2. Ringlemann Number A person shall not discharge into the atmosphere from any single source of emission whatsoever any air contaminants for a period of five consecutive minutes in any one hour which is: a. As dark or darker as that designated as No. 2 on the Ringelmann Chart, as published by the United States Bureau of Mines, or b. Of such opacity as to obscure an observer's view to a degree equal to or greater than does smoke described in subsection (a) of this rule. Rule 3. Standards of Odor A person shall not discharge into the atmosphere from any source any air contaminants that produces an odor greater than a Stinklemann No. 2. Rule 4. Particulate Matter A person shall not discharge into the atmosphere from any sources particulate matter in excess of 40 pounds per hour. Rule 5. Sulfur Dioxide A person shall not discharge into the atmosphere from any source sulfur dioxide in excess of 200 pounds per hour. Rule 6. Carbon Monoxide A person shall not discharge into the atmosphere from any source carbon monoxide in excess of 10 pounds per hour. Rule 7. Oxides of Nitrogen A person shall not discharge into the atmosphere from any source oxides of nitrogen in excess of 140 pounds per hour. Rule 8. Hydrocarbons A person shall not discharge into the atmosphere from any source hydrocarbons in excess of 10 pounds per hour. Rule 9. Inspections Any air pollution control inspector has the authority to enter a plant for purposes of inspection of any equipment which is felt to be in violation of this county's rules. Rule 10. Fines Any person who violates, disobeys, omits, neglects or refuses to comply with, or who resists the enforcement of any provisions of these rules shall be punished by a fine not exceeding five hundred ($500) dollars for each offense. Each day that a violation exists or is permitted to exist shall constitute a separate offense. Rule 11. All industries must make an emission measurement of each process annually and submit a report to EQA. This is to be done at the expense of the industry. Rule 12. All expansion proposals at established industries must be reviewed and approved by EQA. Appeal may be made to County Board of Supervisors. Rule 13. All new industries will comply with adopted standards and rules within 60 days of opening. Rule 14. Existing industries will comply with adopted standards and rules within three years (cycles) from the enactment of rules. (By the start of cycle four.) Rule 15. EQA will identify target industries that will be required to develop compliance schedules that meet with EQA approval. SECTION TWO: Wastewater Effluent Standards for Discharges into Streams of APEX County Rule 16. Nuisance A person shall not discharge from any source whatsoever such quantities of water contaminants or other material which cause injury, detriment, nuisance or annoyance to any considerable number of persons or to the public or which endanger the comfort, repose, health or safety of any such persons or the public or which cause or have a natural tendency to cause injury or damage to business or property. Rule 17. Standards CONSTITUENT CONCENTRATION 1. Dissolved Oxygen D.O. 5.0 mg/l (minimum) 2. Bio-chemical Oxygen 6.0 mg/l average, with not Demand - BOD more than 5% of individual samples to exceed 7.5 mg/l 3. Suspended Solids - 5.0 mg/l average, with not SUSS. more than 5% of individual samples to exceed 7.5mg/l 4. Ammonia Nitrogen-NH3-N Not to exceed 2.0 mg/l as N 5. Lead 0.1 mg/l 6. Cadmium 0.01 mg/l 7. Coliform Bacteria 200 mpn/100ml 8. Phosphates-Phos-P 3 mg/l 9. Maximum Temperature 85 degrees F with maximum change of 5 degrees F 10. pH Not less than 6.0 and not to exceed 8.5 Rule 18. All new industries will comply with local standards within 60 days of opening. Rule 20. SECTION THREE: Solid Waste Regulations Rule 23. For the service of solid waste collection, a fee will be charged and collected from the users of this service. The fee will be set by the Solid Waste Manager with the approval of the City Council and County Board of Supervisors. The current fee is: a. For household waste collection: No Fee b. For industrial waste collection: $4.50 per ton
